1. Acceptance of Terms

Welcome to Aspire Solutions, APC dba Aspire LaShine ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of aspirelashine.com (the "Site") and our real estate, mortgage, and advisory services (collectively, the "Services").

By accessing or using our Site or Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not access or use our Services. We may modify these Terms at any time; continued use after changes constitutes acceptance.

3. User Eligibility and Registration

You must be at least 18 years old and have the legal capacity to enter contracts. You agree to provide accurate information, keep your credentials secure, and accept responsibility for activity under your account.

4. Real Estate and Mortgage Services Terms

4.1 Professional Relationship

When you engage our Services, a professional relationship is established governed by California real estate and mortgage laws, written agreements, professional standards, and MLS rules.

4.2 Fiduciary Duties and Disclosure

  • Loyalty and undivided attention to your interests
  • Confidentiality of personal and financial information
  • Full disclosure of material facts affecting the transaction
  • Reasonable care and skill in performing our services
  • Accounting for all funds and documents

4.3 Property Information Accuracy

While we strive to provide accurate information, we make no warranties regarding square footage, condition, zoning, or pricing. All property information should be independently verified and professional inspections obtained.

5. User Conduct and Prohibited Uses

  • Violating any law or regulation
  • Posting unlawful, harmful, threatening, or defamatory content
  • Impersonating others or misrepresenting affiliation
  • Interfering with the Services or attempting unauthorized access
  • Using automated systems to scrape data
  • Engaging in discrimination prohibited by fair housing laws
  • Misrepresenting property or transaction terms

6. Intellectual Property Rights

The Services and their content are owned by Aspire Solutions, APC and protected by copyright, trademark, and other laws. You are granted a limited, non-exclusive, non-transferable license to access the Site for personal, non-commercial purposes. MLS data, public records, and third-party content remain the property of their respective owners.

7. Privacy and Data Protection

Your use of the Services is also governed by our Privacy Policy, which is incorporated by reference. In real estate and mortgage transactions, we may be required to share information with other agents, lenders, title companies, escrow agents, government agencies, and professional service providers.

8. Financial Terms and Payment

Our compensation is typically earned through commission payments from successful transactions, management fees, mortgage broker fees, or written advisory agreements. All fees will be disclosed in writing before services are rendered.

You are responsible for third-party costs including inspections, appraisals, title insurance, escrow, attorney fees, loan origination, and government taxes and recording costs.

9. Disclaimers and Limitations

Our Services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of merchantability, fitness for a particular purpose, accuracy, uninterrupted operation, or security.

Real estate and mortgage transactions involve inherent risks. We cannot guarantee successful completion, particular pricing, market performance, or absence of title or property defects.

10. Limitation of Liability

To the fullest extent permitted by law, Aspire Solutions, APC and its officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or business opportunities. In no event shall our total liability exceed the fees paid by you to us in the twelve (12) months preceding the event giving rise to liability.

11. Indemnification

You agree to indemnify, defend, and hold harmless Aspire Solutions, APC and its affiliates from any claims, liabilities, damages, or expenses (including reasonable attorneys' fees) arising out of your use of the Services, your violation of these Terms, or content you provide.

12. Termination

Either party may terminate the relationship at any time, with or without cause, upon written notice. We may suspend or terminate access immediately for violations of these Terms, fraudulent or illegal activity, or risk to our business or other users. Termination does not affect rights that arose prior to termination, including pending transactions and confidentiality obligations.

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles.

13.2 Jurisdiction and Venue

Any legal action shall be brought exclusively in the state or federal courts located in Los Angeles County, California.

13.3 Mediation and Arbitration

The parties agree to attempt resolution through mediation before pursuing legal action. If mediation is unsuccessful, disputes may be subject to binding arbitration under American Arbitration Association rules, unless prohibited by applicable law or professional regulation.

14. General Provisions

  • Entire Agreement — these Terms, Privacy Policy, and any service agreements form the complete agreement
  • Severability — invalid provisions do not affect the remaining provisions
  • Waiver — failure to enforce a right is not a waiver of that right
  • Assignment — you may not assign without our consent; we may assign without restriction

15. Professional Licensing and Compliance

Aspire Solutions, APC dba Aspire LaShine is licensed to conduct real estate and mortgage business in the State of California.

DRE 02247147 · NMLS ID 886370. All activities are conducted in compliance with California real estate law, the Fair Housing Act, TILA/RESPA, AML/BSA, and local licensing requirements.
